These Terms of Service ("Terms") govern your access to and use of My CPA, a platform operated in Kenya that connects businesses ("Employers") with certified public accountants and other accounting professionals ("Professionals") for job postings, hiring, and paid engagements. By creating an account or otherwise using My CPA, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. Description of Service
My CPA is a marketplace that allows Employers to post job opportunities and search verified Professional profiles, and allows Professionals to build a profile, apply to jobs, and get hired. My CPA facilitates these connections and related payments but is not a party to, and does not guarantee the outcome of, any engagement between an Employer and a Professional.
2. Eligibility & Accounts
You must be at least 18 years old and able to form a binding contract to use My CPA. When you register, you agree to:
- Provide accurate, current, and complete information about yourself or your business.
- Keep your login credentials confidential and notify us immediately of any unauthorized use of your account.
- Be responsible for all activity that occurs under your account.
Professionals may be required to submit proof of qualification (such as CPA certification or membership number) for verification. My CPA may suspend or reject accounts that fail verification or provide false information.
3. Job Postings & Engagements
Employers are solely responsible for the accuracy of their job postings and for evaluating and selecting Professionals. Professionals are solely responsible for the accuracy of their profiles and the quality of work delivered. My CPA does not guarantee that any job posting will result in a hire, or that any engagement will meet either party's expectations, and is not responsible for the conduct of any Employer or Professional, on or off the platform.
4. Fees, Wallet & Payments
My CPA provides an in-app wallet that supports deposits and withdrawals via M-Pesa to facilitate payments between Employers and Professionals. Where payments for an engagement are processed through the platform, My CPA retains a platform commission of 10% of the transaction value to cover operating costs. Remaining funds are credited to the Professional's wallet and may be withdrawn to a registered M-Pesa number, subject to applicable transaction fees and verification checks.
You are responsible for providing accurate payment details. My CPA is not liable for funds sent to an incorrect phone number or account provided by you. Disputed transactions should be reported to support as soon as possible so we can investigate.
5. Professional Conduct
You agree not to:
- Post false, misleading, or fraudulent job listings, profiles, or reviews.
- Circumvent the platform to avoid fees after a connection was made through My CPA.
- Harass, discriminate against, or misrepresent yourself to another user.
- Upload content that infringes another person's intellectual property or violates any law.
- Use the platform for any unlawful, deceptive, or harmful purpose.
Violation of these rules may result in suspension or termination of your account, in addition to any other remedies available to us under law.
6. Intellectual Property
The My CPA name, logo, website, and mobile application, along with their underlying software and design, are owned by My CPA and protected by applicable intellectual property laws. You retain ownership of content you upload (such as your profile, CV, or job descriptions), but grant My CPA a limited license to display and use that content to operate and promote the platform.
7. Privacy
Your use of My CPA is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data, including information submitted for identity verification and payment processing.
8. Disclaimers & Limitation of Liability
My CPA is provided on an "as is" and "as available" basis. We do not warrant that the platform will be uninterrupted, error-free, or secure at all times. To the maximum extent permitted by law, My CPA and its owners, employees, and partners will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, or from any engagement between an Employer and a Professional.
9. Termination
You may deactivate your account at any time by contacting support. My CPA may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or created risk or legal exposure for us or other users.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or relating to these Terms or your use of My CPA will be subject to the exclusive jurisdiction of the courts of Kenya.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes to our platform or legal requirements. If we make material changes, we will notify users through the platform or by email. Continued use of My CPA after changes take effect constitutes acceptance of the revised Terms.
